M5 Junction 10 Improvement Scheme; Commitment to use Compulsory Purchase Powers

As detailed within the June 2020 Cabinet paper, Gloucestershire County Council (GCC) is continuing to work with Homes England to enter into a Grant Determination Agreement (GDA) in relation to the M5 Junction 10 Improvement Scheme. In June 2020, Cabinet approved the recommendations to enter into this agreement (recommendations 3, 4 and 5) which included agreeing the terms and conditions that give rise to the GDA between GCC and Homes England.


A key condition is Condition 12; ‘Provide evidence of commitment that Compulsory Purchase Order (CPO) powers will be used if required to deliver the Housing Infrastructure Fund – Forward Funding (HIF FF) infrastructure’.


To satisfy this condition and to enable the progression of the GDA, a commitment by way of Cabinet approval is sought by Homes England.


The purpose of the report is;


For Cabinet to agree a resolution in principle to exercise its powers of compulsory purchase for the acquisition of land in respect of the M5 Junction 10 Improvement Scheme via Compulsory Purchase Order under the Highways Act 1980 (as delegated to GCC under section 8 of the said Act) and the Acquisition of Land Act 1981; or via a Development Consent Order under the Planning Act 2008 as appropriate, in addition to the negotiated settlement route for acquisition of land required for the scheme.
