In coming to this decision, I have given due and full regard to the requirements of the public sector equality duty contained in section 149 of the Equality Act 2010 (“the Act”) by reference to the law itself.
Having fully considered all of the available information, I have decided to reject the alternative options and take the recommended decision to approve:
a) To extend the completion dates of the following contracts awarded to Gigaclear as part of Stage 3 of the Fastershire delivery programme. This change request is linked to a previous change request agreed in March 2020 where the number of premises included within each Lot was increased:
· Lot 2/3c: south Herefordshire and Gloucestershire (west of the River Severn) from March 2022 to December 2022;
· Lot 3d: north Gloucestershire from June 2021 to April 2022;
· Lot 3e: south Gloucestershire from December 2021 to September 2022.
b) The incorporation of a Stage 6 into the Fastershire delivery programme to include those premises that would form part of Building Digital UK’s (BDUK) Project Gigabit. BDUK are part of the Department for Digital, Culture, Media and Sport (DCMS).
c) The transferring of 1,187 premises from Lot 2/3c of Stage 3 of the Fastershire delivery programme due to escalating costs of delivery to the newly created Stage 6 so they can be included for the future procurement process managed by BDUK.
d) A review of the community offer provided as part of Stage 5 of the Fastershire delivery programme in Gloucestershire with the aim of maximising funding for reinvestment in the digital network.
For the reasons set out in the report.
