Minutes: 7.1 Andrew Houldey, Asset Data Officer (PROW Definitive Map), gave a detailed presentation to the Committee aided by a PowerPoint presentation, which included photographs of the claimed route under consideration. (For information: A copy of the presentation slides have been uploaded to the Council’s website.)
7.2 The Committee considered the application for a Definitive Map Modification Order (DMMO) for an additional length of public footpath at Longney Crib, in the parish of Longney and Epney. On the Plan attached at Appendix 1B to the report the way was shown running between points A, B and C by a red line; the claimed path ran parallel to an existing public footpath ELY 16 which was shown by a dotted line between points A, X, C and D.
7.3 The Asset Data Officer reported that the riverside path ELY 16 formed part of the designated Severn Way. This was a long-distance route that ran for 215 miles along the entire Severn Valley from the source on Plynlimon in Mid Wales to Severn Beach before following the River Avon into Bristol City Centre. The claimed route was located immediately adjacent to the eastern boundary wall of the house of 1 Crib Cottages; the land which the claimed path ran across was owned by the Henry Smith Charity.
7.4 The documentary evidence did not suggest that the public footpath ELY 16 was added in error to the Definitive Map and Statement under the provisions of the 1949 National Parks and Access to the Countryside Act. Therefore if the claimed path was added to the Definitive Map, it would not affect the existing public footpath ELY 16.
7.5 He reported that the close proximity of public footpath ELY 16 to the claimed path, and any safety considerations of the claimed path were in the main irrelevant to the determination of the application. The proximity of either of the two paths to any of the properties was also irrelevant. However, he directed the Committee to note that the two paths were linked in terms of their determination of the application.
7.6 There was no documentary evidence that had been uncovered for the claimed path. On the Ordnance Survey Map 25” to 1 mile maps, 2nd edition Glos 32.16 and 40.4 (1902) 1902 at Appendix 1E, the public footpath ELY 16 was shown by double pecked lines, going to the west of the cottages at Longney Crib (plot 325a) and then shown running south through plot 325. The public footpath was shown in the same place on the 1923 edition.
7.7 The Ordnance Survey Map 1: 2,500 SO 7611-7711 1973 at Appendix 1F, did not show public rights of way, but did describe the physical characteristics of any ways, tracks, or paths. The claimed path was not shown, but the embankment was shown to the east of The Crib. Public footpath ELY 16 was shown by double pecked lines, running to the west of The Crib and then running south.
