Cabinet Member approval for the Executive Director of Economy,
Environment & Infrastructure to be authorised to conduct a
compliant competitive tender process and to award a contract in
respect of the B4063 Gloucester to Cheltenham Cycle Improvements;
and
• upon conclusion of the competitive tender process, in
consultation with the Cabinet Member for Environment and Planning
and following Executive Decision Paper approval, to enter into a
contract with the preferred provider evaluated as offering the
Council best value for money for delivery of the services. In the
event that the preferred provider for the contract is either unable
or unwilling to enter into that contract with the Council then the
officer is authorised to enter into such contract with the next
willing highest placed suitably qualified provider
In coming to this decision I have given due and full regard to the requirements of the public sector equality duty contained in section 149 of the Equality Act 2010 (“the Act”) by reference to the law itself and also the relevant Due Regard Statement, which was prepared in accordance with the requirements of the Act.
Having fully considered all of the available information, I have decided to reject the alternative options and take the recommended decision to:
Delegate authority to the Head of Highway Authority (in consultation with the Cabinet Member for Environment and Planning) to:
1. Conduct competitive procurement processes for the supply of highway construction works in relation to the B4063 Gloucester to Cheltenham Cycle Improvements scheme; and then award a contract(s) for such
works to the successful tenderer(s); and
2. Make such ancillary traffic regulation orders as may be required in order to successfully implement such scheme, including (without limitation), temporary traffic regulation orders (TTRO’s for speed limits etc.) during
the construction phase of the scheme.
