M5 Junction 10 Improvements Scheme – Delegating Authority

Decision Maker: Cabinet Member - Environment and Planning

Decision status: Recommendations Approved

Is Key decision?: Yes

Is subject to call in?: Yes

Purpose:

To seek a Cabinet Member decision that formally delegates authority to GCC officers to represent the Council through the Development Consent Order process of the Junction 10 Improvements Scheme

Decision:

In coming to this decision, I have given due and full regard to the requirements of the public sector equality duty contained in section 149 of the Equality Act 2010 (“the Act”) by reference to the law itself and also the relevant Equality Impact Assessment, which was prepared in accordance with the requirements of the Act.

Having fully considered all of the available information, I have decided to reject the alternative options and take the recommended decision to delegate authority to:

·         the GCC officers set out in Appendix A to respond formally on behalf of Gloucestershire County Council (as a statutory consultee) to the M5 Junction 10 Improvements Pre-application DCO consultation;

·         the Lead Commissioner for Strategic Infrastructure to submit the response on behalf of the County Council as statutory consultee; and

·         the Lead Commissioner for Strategic Infrastructure to authorise additional staff (if necessary, in consultation with LCM) that need to respond as he considers necessary.
