To consider the following application:

 

An application to register land known as “”The Humpty Dumps” at Bowling Green Lane, Cirencester, Gloucestershire as a new town or village green.

Carrie Denness, Principal Lawyer, presented the report on the application to register land known as “The Humpty Dumps” at Bowling Green Lane, Cirencester, Gloucestershire as a new town or village green.

 

During a detailed introduction Ms Denness highlighted that the application before the Committee failed the legal tests both for proof of locality and on the production of sufficient evidence to prove use of the site for lawful sports and pastimes for the required period of 20 years.

 

The Committee noted the findings of the Inspector following the non-statutory public inquiry held on 17 to 21 November 2014.

 

Ms Denness confirmed in response to questions from Members that no information was available on the site owners plans for possible development of the site in the future.

 

Having considered the information before it including the Inspector’s recommendation, the Committee

 

Resolved

 

That the Application dated 17 January 2013 made by FROTH (“the Applicant”) for the registration of an area of land known as “The Humpty Dumps” at Bowling Green Lane, Cirencester, Gloucestershire (as shown edged red on the plan attached to the Application Appendix 1) as a town or village green pursuant to section 15(3) of the Commons Act 2006 be REFUSED for the reasons set out in the Inspector’s report attached at Appendix 2.
